This page contains the Terms of Use and the Privacy Policy for the Vendor Stall Marketplace. The Vendor Stall Directory is a separate service with separate accounts and its own legal page.
These Terms of Use ("Terms") are an agreement between you and Vendor Stall ("Vendor Stall," "we," "us," or "our") and apply to your use of the Vendor Stall Marketplace at https://www.vendorstall.com (the "Marketplace"), including any related mobile apps. By creating an account or using the Marketplace, you agree to these Terms and to the Privacy Policy below. If you do not agree, do not use the Marketplace.
The Marketplace is a venue where members list items for sale and other members bid on or buy them. Vendor Stall is not the buyer or seller and is not a party to any sale between members. We do not control, and are not responsible for, the quality, safety, legality, or description of items, or whether members complete a sale.
You must be at least 18 years old and able to enter into a binding contract to use the Marketplace. If you use the Marketplace on behalf of a business, you confirm that you are authorized to accept these Terms for that business.
You must give accurate information when you register and keep it up to date. You are responsible for keeping your password confidential and for all activity on your account. Tell us right away through the contact page if you believe your account has been used without your permission. Marketplace and Directory accounts are separate.
Sellers must describe items accurately, have the right to sell them, and complete sales on the terms they list. Buyers who win an auction, use a buy-it-now option, or have an offer accepted agree to pay for the item. Any sale is a contract between the buyer and the seller.
Some features, such as listing fees, listing upgrades, and store subscriptions, may carry fees. Current fees are shown on the Site Fees page. Fees are charged in U.S. dollars through third-party payment processors and are non-refundable unless required by law. Subscriptions renew automatically until you cancel. We may change fees by posting the new fees on the Marketplace.
"Your content" means anything you post or send through the Marketplace, such as listings, photos, descriptions, feedback, and messages. You keep ownership of your content. You give Vendor Stall a non-exclusive, worldwide, royalty-free license to host, copy, display, adapt, and distribute your content to operate and promote the Marketplace. You confirm that you have the rights to post your content and that it does not violate these Terms or anyone else's rights. We may remove any content at any time.
You may not:
Items in the Adult category must be lawful and may be sold only to buyers 18 or older.
If you believe content on the Marketplace infringes your copyright, send us a notice through the contact page that includes: your name and contact information; a description of the copyrighted work; the location (URL) of the material; a statement that you believe in good faith the use is not authorized; a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove infringing material and may terminate the accounts of repeat infringers.
We may suspend or terminate your account, or remove listings, at any time if we believe you have broken these Terms or the law, or to protect members or Vendor Stall. You may stop using the Marketplace and ask us to close your account at any time. Sections on content, fees owed, disclaimers, liability, and indemnity continue after termination.
The Marketplace is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent allowed by law. We do not guarantee that the Marketplace will be uninterrupted or error-free, or that any listing or member information is accurate.
To the fullest extent allowed by law, Vendor Stall is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Marketplace or from any transaction between members. Our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim or US $100.
You agree to defend and hold harmless Vendor Stall from any claims, losses, and expenses, including reasonable legal fees, arising from your content, your listings and transactions, or your breach of these Terms.
These Terms are governed by the laws of the United States of America and, where required, the laws of the applicable state.
We may update these Terms from time to time. We will post the updated version on this page with a new effective date. If you keep using the Marketplace after a change, you accept the updated Terms.

We use information to run the Marketplace; manage accounts; support listings, bidding, and sales; process fees; prevent fraud and abuse; provide support; send account notices and, if you choose, newsletters; improve our services; and meet legal obligations.
We do not sell your personal information for money.
We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Marketplace is used. If we show ads, third-party advertising partners may use cookies to show and measure ads. You can block or delete cookies in your browser settings, but some features may not work. We do not currently respond to browser "Do Not Track" signals.
Every marketing email we send includes an unsubscribe link, and we honor unsubscribe requests promptly as required by the CAN-SPAM Act. Account and transaction notices are part of the service. The Marketplace and Directory newsletters are separate.
We use reasonable safeguards to protect your information, but no method of transmission or storage is completely secure.
We keep personal information as long as your account is active and as long as needed to provide the service, resolve disputes, enforce our Terms, and meet legal, tax, and accounting requirements. After that, we delete it or make it anonymous.
The Marketplace is for users 18 and older. We do not knowingly collect personal information from children under 13, in line with the Children's Online Privacy Protection Act (COPPA). If you believe a child has given us information, contact us and we will delete it.
You can update your account information at any time and unsubscribe from marketing emails. Depending on where you live, including California and other states with privacy laws, you may have the right to know what personal information we collect, to access, correct, or delete it, and to opt out of its sale or use for targeted advertising. To make a request, use the contact page. We will not discriminate against you for using these rights.
Zip code, city and state information on Vendor Stall is provided by GeoNames (geonames.org) and is licensed under the Creative Commons Attribution 4.0 License.
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date.
